1. Introduction

This document, along with all referenced policies — including our Privacy Policy, Cookie Policy, Legal Notice, Accessibility Statement, and Terms of Use — outlines the terms that govern your use of the DHOOM website (www.dhoomtoronto.com), and your purchase or reservation of services and products through it.

By using this website or making a reservation or purchase, you agree to these conditions. If you do not agree, please refrain from using the site.

Only reservations made directly through our official website or via authorized partners (e.g., OpenTable) and confirmed by email will be considered valid. Unconfirmed reservations are not recognized.

2. Identification of the Parties

All services and products offered on this website are sold by 15340705 Canada Inc. O/A DHOOM, with its principal place of business located at:

417 Danforth Avenue, Toronto, ON

Any individual using or purchasing through this site is referred to as “the user.”

By accessing this website, you confirm that you are at least 18 years old and legally capable of entering into binding contracts under applicable Canadian law. Minors under 18 must be accompanied by an adult when dining.

3. Reservation Process

You may check availability and book a reservation up to 365 days in advance. If your preferred date or time is unavailable, waitlist options may be provided.

To complete a reservation, you must:

  • Provide accurate contact and billing information

  • Confirm your booking via the email received

  • Agree to our cancellation policy (outlined below)

3.1 Cancellation Policy
  • You may modify or cancel your reservation up to 48 hours in advance with no charge

  • Changes or no-shows within 48 hours will incur a fee of CAD $150 per person

  • Credit card details are required to confirm the booking and authorize the cancellation fee if applicable

  • No charges are applied at the time of booking unless the cancellation policy is violated

  • Reservations not confirmed by email will be considered invalid

  • Group bookings (10 guests or more) may require a deposit or pre-set menu agreement

Please retain your confirmation email as proof of your reservation.

Note: Guests may be photographed or filmed on-site for promotional purposes. If you prefer not to be included, notify a staff member upon arrival.

4. Product Purchases (e.g., Gift Cards)

Digital and physical gift cards can be purchased through the website, subject to availability. You will receive confirmation once the transaction is successfully processed.

Promotional or complimentary gift cards may carry expiration dates, in accordance with Ontario law.

5. Product Availability

While we strive to keep inventory accurate, product availability is not guaranteed. If an item is unavailable, you will be notified and offered alternatives or a refund.

6. Pricing

All listed prices include applicable Canadian taxes (HST). Shipping costs, if applicable, will be calculated separately and displayed at checkout.

If a pricing error occurs, we will notify you for confirmation before processing or cancel the order and issue a refund.

7. Payment Methods

We accept Visa, MasterCard, and American Express. Payments for reservations are only charged in the event of cancellation penalties.

8. Refund Policy

Refunds are issued only to the original method of payment. Alternate refund methods are not offered.

9. Right of Withdrawal (Physical Products Only)

You may withdraw from a physical product purchase within 14 days of receipt. Returned items must be unused and in original condition. Return shipping is the buyer’s responsibility.

This policy does not apply to food items, reservations, or personalized services.

To request a return, contact us within 14 calendar days of delivery. Requests beyond this period will not be accepted.

10. Shipping Policy

We ship physical products within Canada. Estimated delivery time is 3–5 business days. Delays do not warrant cancellation or compensation.

DHOOM is not responsible for any personal belongings left behind. Found items will be held for 7 days.

11. Returns & Exchanges

Returns are accepted within 14 days of receipt, provided the product is unused and in original condition. Used or damaged items are non-refundable.

If the item was defective, we will also refund the original shipping fee. Otherwise, shipping costs are non-refundable.

12. Guarantees

All products and services are provided “as is.” In accordance with Canadian consumer protection laws, we provide remedies for items that do not match their description or meet quality expectations.

While we do our best to accommodate allergies and dietary restrictions, we cannot guarantee an allergen-free environment.

13. Gift Cards

Gift cards never expire and can be used toward any services offered, including dining and events. They are non-refundable and non-transferable. Expiry dates are not applied, in compliance with Ontario consumer protection law.

14. Force Majeure

DHOOM is not responsible for delays or disruptions caused by circumstances beyond our control, including natural disasters, pandemics, strikes, or infrastructure issues.

15. Dispute Resolution

In the event of a dispute, both parties agree to attempt resolution through good-faith negotiation. If unresolved, disputes may be escalated to small claims court or resolved through arbitration, under Ontario law.

16. Jurisdiction

These terms are governed by the laws of the Province of Ontario. Any disputes will fall under the jurisdiction of Ontario courts.

17. Marketing Communication

By making a reservation or purchase, you consent to receive occasional promotional updates from DHOOM. You may unsubscribe at any time.
